GENERAL TERMS OF SERVICE

Pay up front for orders below USD50.

Must be paid in USD

Product will be delivered digitally.

Seller will not be responsible for loss of product once it has been delivered.

Customer has right to three (3) complete revisions in the sketching phase.

Customer has right to three (3) minor edits after completion (I.E eyecolour change)

Customer can ask for a refund on orders with no progress for two (2) months, or when work has not been completed within four (4) months.

Customer is required to contact the Seller in a fast and responsive manner.

The Seller has every right to decline, refuse, or cancel any order without giving reasons to Customer.

Products cannot be used for commercial use without additional fees.

Customer must provide visual references. Non-visual references may result in additional fees or be declined.

Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.

Customer does not hold the right to use the product in any AI-related technology, including submitting for datasets, and any future inventions in the space.

PAYMENT

All prices are in USD

Payment is via Stripe only. An invoice will be sent by the Seller.

Listed prices are the base price. The price may increase depending on additional details and the complexity of the Product.

Customer must provide visual references. Non-visual references may result in additional fees or be declined.

Up front payments are expected for orders below USD50 per Product.

Order above USD50 payment is split into two parts: Before starting (50% deposit) and before delivery (50% balance).

All deposits and payments are NON-REFUNDABLE.

The 50% deposit must be paid before the Seller start working.

The final file will not be delivered until full balance payment is received.

Rush or queue-jump Product are accepted with an additional fee.

PRODUCT DELIVERY

Customer agrees that Product will be delivered digitally to email address provided by Customer, after the final payment has been received by the Seller.

Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Customer is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.

It is sole responsibility of Customer to propose delivery method which works for both parties. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.

Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.

REVISIONS

Customer has the right to three (3) complete revisions in the sketching phase.

Customer has right to a three (3) of minor edits after completion, such as changing an eye colour or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered Product.

Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such excessive requests will not commence until the payment for the additional invoice(s) has been received.

CANCELLATIONS

There will be no refund if for any reasons Customer need to cancel their Product after payment.

Seller reserves every right to refuse or cancel any order, under condition of full or partial refund, without giving reasons to Customer.

Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. Customer will receive full or partial refund depending on amount of work completed. Seller will have full right to refuse any service to the Customer in the future.

CURRENCY CONVERSIONS

Customer agrees to pay the total amount specified in USD.

It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller.

Payment is considered as received and completed only when total amount received on Seller's USD account is equal to the invoice amount in USD.

REFUND POLICY

Customer has right to request a full refund if there's been no progress for two (2) consecutive months, or when Product has not been completed within four (4) months.

Refund conditions for commissions which require more work must be agreed separately, before the work commences.

These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.

Customer obliges to contact the Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc.

Lack of timely communication on behalf of Customer will be recognized as implicit approval of all work progress and current state of the Product.

PERSONAL AND COMMERCIAL USE

The Product received by Customer is for personal use only and may be used as profile pictures/banners, but may not be used for profit.

Reposting and sharing of the artwork is permitted, but Customer must give credit to @ettochiiart.

The Seller own all rights to the Product and the Seller is allowed to post on their social media unless requested otherwise (Additional fee will be required).

The Seller is allowed to include the Product into their portfolio.

Fanart Product consisting of characters from any game/series/etc may be used by the Seller to produce physical prints and other merchandise for the Seller's shop as they see fit.

Please contact the Seller via email for commercial works; there will be additional fees for commercial rights.

Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller.

This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product.

Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.

In addition, Customer does not hold the right to use the product for AI datasets or for AI tools and any present or future inventions in the space.

Digital Art / Live2D Art Process

Customer must provide visual references. Non-visual references may result in additional fees or be declined.

Before starting, the seller will send a deposit invoice.

Once deposit payment received, the seller will start working on the sketch (and flat color if necessary).

Once sketch is completed, the seller will send progress of the sketch for the customer review to approve or make revisions before the seller proceed to finish the artwork.

Maximum of three (3) complete revisions on the sketch phase is allowed. More than three (3) will incur an additional fee that must be paid in full before the seller proceed to make adjustments.

Once the seller receive confirmation of the sketch to continue working, refunds may not be requested at this point unless issued by the seller.

Once the work is completed, the seller will send one final invoice for your review. Three (3) minor revisions may be requested. More than three (3) will incur an additional fee that must be paid in full before the seller proceed to make adjustments.

Once the finalized work is accepted, the seller will email the customer the end Product.

No physical product will be delivered.

For Live2D art only work, the seller may also recommend riggers for other's model rigging service if needed.

The seller reserves the right to decline a commission request based on their skills .

Live2D Rigging Process

Before starting, the seller will send a deposit invoice.

Once deposit payment received, the seller will start working.

If illustration of other artists provided, please provide a fully layered PSD file. Layer separation service is available at an additional cost. The file must be the final version—major illustration changes during or after rigging are not recommended.

The seller is not responsible for the quality of the illustration. Minor flaws can be adjusted, but the seller cannot provide large-scale drawing fixes.

The seller reserves the right to decline the work based on their skills or due to the provided model quality issues (e.g. unnatural proportions, incorrect file format, major layer separation errors, etc.).

AI-generated illustrations are not accepted for Live2D rigging commissions.

The original working file (.cmo3) will not be provided. Purchasing the original file will be handled as a full buyout.

Reselling the commissioned work to third parties for profit is prohibited.

Live2D Software and Tracking

Recommended Facetrack software: Vtube Studio

Recommended Facetrack device: Highly recommend to use iOS!

If the customer are not familiar with VTube Studio / OBS, the seller may provide basic guidance, but full step-by-step training is not included. Please refer to tutorials on YouTube for detailed instructions.
